FunMan Terms of Service

1. Who we are and how you agree

ApeXhit LLC (“ApeXhit,” “we,” “us”) is a Florida limited liability company. FunMan is our multi-tenant funnels, CRM, and client-lifecycle tool at https://funman.apexhit.org.

These Terms govern FunMan only. They do not replace the hub documents at https://apexhit.org/legal. Other ApeXhit apps have their own terms.

By checking “I agree” and creating or using a FunMan tenant, you agree to these Terms and to the FunMan Privacy Policy on behalf of the business named on that tenant. If you do not agree, do not create a tenant and do not use FunMan.

You represent that you are at least 18 and that you have authority to bind that business.

2. What FunMan is

FunMan lets a business: catch leads from a website form into that business’s own tenant; ping the shop team in Discord when a new lead arrives and when a lead moves boards; optionally text opted-in owner and staff phones with the same informational account notifications; move jobs through a pipeline (for example New → Estimate → Quote → Active → Completed); give owner and staff seats, with an audit trail. Customer Google review-request texts are parked.

FunMan is a software tool. It is not a law firm, not a marketing agency engagement, and not a promise of leads, jobs, or reviews. We may add, change, or drop features.

3. Accounts and tenants

Each business gets its own tenant. You are responsible for your staff. Do not share owner credentials.

We try to keep one tenant’s records from mixing with another’s. Isolation is how FunMan is built. It is not a guarantee that nothing will ever go wrong. Tell us promptly if you see someone else’s data.

We may suspend a login or a tenant if we believe these Terms were broken, if a bill or even-exchange is unpaid, or if we have to in order to protect the service or other customers.

4. Who owns what

ApeXhit owns FunMan: the software, the FunMan name, templates, pipeline design, and the platform.

You own your Client Data: the leads, job notes, phone numbers, names, and other records your business puts in your tenant, plus logo, photos, and copy you upload.

You give ApeXhit a limited license to host and process Client Data only to run FunMan for you, keep it working, secure it, and follow the law. We do not sell Client Data.

A custom marketing website we build for you is a separate job. These FunMan Terms do not assign that website’s copyright. That takes a signed writing.

4A. Public forms vs these Terms

A visitor who fills out your public FunMan form is dealing with your business, not signing ApeXhit’s Terms. Their submission becomes your Client Data.

FunMan may let you put a consent checkbox or an e-signature field on your form. Those are your tools for your customers. They are not how anyone agrees to these FunMan Terms.

You agree to these Terms only by the required checkbox at tenant create (or first login), with links to /terms and /privacy. A Working Together intake can later use a consent field inside your tenant. E-sign is not part of this FunMan signup.

5. SMS

FunMan may send informational account-notification texts to opted-in owner and staff phones: (1) when a lead arrives from a funnel or form into the CRM, and (2) when that lead moves to another board or pipeline stage. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Consent is not required to use FunMan.

These texts are for the shop team, not customers. Visitors who fill a public form are not opted into FunMan SMS. Customer marketing texts, including Google review-request texts, are parked on this campaign.

Every FunMan team text will include a simple way to opt out, such as STOP. STOP, HELP, and START are handled by Twilio on the sending number, not a FunMan in-app switch. We will honor opt-outs we receive through that path.

You are responsible for the numbers you store. FunMan is the tool. We may pause or stop sending if a carrier, a platform, or the law requires it, or if sending looks abusive.

This section describes how the product works. It is not a legal conclusion about telephone, marketing, or privacy statutes, and it is not legal advice.

Do not use FunMan to text people who asked you not to, to send junk, or to send anything unlawful.

6. Acceptable use

Do not break the law; try to read another tenant’s data; upload data you have no right to store; harass, spoof, or spam; or copy FunMan and resell it as your own product.

7. Fees, pause, export, and deletion

Paid tenants pay the fees we quote in writing or in the product. Late or missing payment: we may pause SMS and logins after notice. A missed even-exchange counts as non-payment for pause and deletion.

Before we delete a paused tenant, you may request an export of Client Data (CSV or JSON) at apexhit00@gmail.com. We aim to give 14 days after pause before deletion. Backups may linger for a short time. Those windows are our practice, not a statute we are quoting.

These Terms do not bind anyone who has not agreed to them, including by the I-agree checkbox. We will not treat an old handshake as if these pages had already been signed.

8. Disclaimers

FUNMAN IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that FunMan will be uninterrupted, error-free, or that leads, Discord pings, or optional team SMS will always go through. Carriers can drop texts. You are responsible for following up on leads.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXHIT LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM FUNMAN.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR FUNMAN IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). If the tenant is an even-exchange with no cash to us, (A) is zero and (B) still applies.

Some places do not allow some of these limits. There we limit liability to the fullest extent the law allows.

10. Your responsibility

You agree to indemnify ApeXhit LLC from claims and reasonable legal fees that come out of Client Data you put in FunMan, texts FunMan sends at your direction, or your breaking these Terms.

11. Florida law

Florida law governs, without conflict-of-law rules. First email apexhit00@gmail.com. If that does not resolve it in 30 days, Florida state and federal courts have exclusive jurisdiction.

12. Changes

We may update these Terms. The effective date at the top will change. Keep using FunMan after an update and you accept the new Terms. For a material change we will try to notice the tenant owner in the product or by email if we have one.
